HEALTH AND SAFETY

Is to establish the necessary measures to prevent accidents and illnesses, tending to make the provision of work to develop safe, hygienic and suitable environment for employees, in accordance with the provisions of the Federal Labor and the international treaties signed and ratified by the United Mexican States on these matters.I. Hazardous activities: The set of tasks deriving from the work processes that create unsafe conditions and overexposure to physical, chemical or biological, capable of causing damage to the health of workers or the workplace;II. Place of work: All of that place, whatever their denomination, which made the production, marketing or services, or people who work are subject to an employment relationship;III. Work environment pollutants: These are the physical, chemical and biological agents capable of modifying the environmental conditions of the workplace, which of its properties, concentration level and exposure time or action may adversely affect the health of workers;IV. Equipment for transportation of materials: Are the vehicles used for transporting materials of any kind, either continuously or intermittently between two or more workstations for the production process in the workplace;V. Ergonomics: The adequacy of the workplace, equipment, machinery and tools the worker, according to their physical and mental, to prevent accidents and illnesses and optimize the activity of this with the least effort and avoid fatigue and human error;VI. Confined Space: It is a place large enough, with poor natural ventilation, so arranged that a person can play within an assigned task, which has limited or restricted means for access or egress, not designed for occupancy by a person continuously and in which specific tasks are performed occasionally;VII. Law: The Federal Labor Law;VIII. Workplace: The place where the worker operates specific job for which he was hired, which interacts with the production processes and work environment;IX. Material: It is any element, compound or mixture, whether raw material, byproduct, or waste product and waste used in the operations and processes, or resulting from these in the workplace;
 
X. Materials and hazardous chemicals:They are those who by their physical and chemical properties to be handled, transported, stored or processed, have the potential flammability, explosiveness, toxicity, reactivity, radioactivity, corrosivity, or harmful biological action, and can affect the health of exposed persons or cause damage to facilities and equipment;XI. Working Environment: The set of natural or human induced, that interact in the workplace;XII. Pathogen: An organism living microscopic producer or that causes disease;XIII. Standards: The official Mexican standards relating to safety, hygiene and working environment issued by the Ministry of Labour and Social Security or other agencies of the Federal Government, pursuant to the Federal Law on Metrology and Standardization ;XIV. Safety and Health Program: A document that describes the activities, methods, techniques and health and safety conditions to be observed in the workplace to prevent accidents and illnesses, even if staffed with specific procedure manuals;XV. Ministry: The Ministry of Labour and Social Welfare;XVI. Health and safety at work: Are the procedures, techniques and elements that are applied in the workplace, for the recognition, evaluation and control of hazardous agents involved in the processes and work activities in order to establish measures and actions to prevent accidents or occupational diseases, to preserve life, health and physical integrity of workers, and to avoid any possible damage to the institution itself;XVII. Preventive services in occupational medicine: are those that are integrated under the supervision of a qualified medical practitioner in occupational medicine or equivalent area, set out to assist in preventing accidents and illnesses and promote physical and mental workers in connection with your work;XVIII. Preventive services and safety: These are integrated by a qualified professional safety and health, which are established to assist in preventing accidents and illnesses through the recognition, evaluation and control of risk factors in order to avoid damage to the health of workers and
 
XIX. Systems for transport and storage of materials:The set of fixed and mobile mechanized elements, used for transportation and storage of any materials and hazardous chemicals, continuously or intermittently between two or more workstations, designed for the production process in the workplace;SAFETY AND HEALTH PROGRAMS IN THE WORKPLACE.In workplaces with a hundred or more workers, the employer must make an assessment of the safety and health conditions prevailing in them, and to establish in writing and implementing a program of health and safety at work to consider the compliance with regulations on the matter, according to the characteristics of the activities and industrial processes.Those companies that are not in the course of the preceding paragraph, shall prepare a list of general and specific preventive measures of health and safety at work, according to the activities developed.The program and the relationship of general and specific measures of health and safety in the workplace referred to in this article shall contain the measures provided for in this Regulation and the Rules. Also the responsibility of the employer have the manuals and safety procedures specific to refer the Standards.Nothing in the preceding paragraph shall also apply to specific programs of safety and hygiene laid down in this Regulation, which must be integrated into the health and safety program, when in the case provided for in the first paragraph of this article.It is the responsibility of the employer to develop, evaluate and, where appropriate, updated periodically, at least once a year, the program or measures regarding safety and health workplace and submitted to the Secretariat when it so required.In developing the program or measures regarding safety and health at work should consider the potential risks, according to the nature of the activities of the company or establishment.In case of changes to production processes, work procedures, facilities, plant layout and thus jobs, or new materials are used, the program or the relationship of health and safety measures in the workplace, be modified and adapted to new conditions and risks.Pattern is the responsibility of disseminating and implementing the program or the relationship of health and safety measures referred to in this Chapter and shall educate and train workers in their application
